I.      CALL TO ORDER

        Chairman Philip Lindquist called the meeting to order at 7:30 p.m.

II.     ACCEPTANCE OF MINUTES

        Acceptance of Minutes of Meeting of April 9, 2007

III.    APPOINTMENTS

        Form A/ANR
        High Street & Independence Ave.

        Board members reviewed a Plan of Land, dated April 17, 2007, prepared by Stenbeck & Taylor, Inc. of Marshfield for Robert and Madeline McCarthy.   The plan divides Assessors Map 64, Lot 11 into two lots.  The lot with the exiting house will retain 40,614 square feet and its existing frontage on High Street.  The second 76,331 square foot lot will have 166.23 feet of frontage on Independence Avenue.

        Hemlock Hills
        Margaret Cunningham

        The Board met with Margaret Cunningham of Steven Street regarding conditions at the Hemlock Hills subdivision off Cross Street.  Mrs. Cunningham told the Board that she lost six trees in her yard during a recent storm because there is no longer any protection due to the number of streets that have been cut down in Hemlock Hills.  She estimated that it will cost $1,200 to $1,400 to have them removed. She said the subdivision used to be forested and now is desert like with piles of sand that blow around and dirty her windows. She recommended that the Board change its regulations and require developers to leave a buffer to protect neighbors. Board members said that it is state law that regulates what developers can do. Town Planner Noreen O’Toole told Mrs. Cunningham that she had gone to her house but no one was at home.  She also told Mrs. Cunningham that developer Robert Brady was willing to meet with her.  The Board suggested that some sort of arborvitae be requested as a buffer. Ms. O’Toole was asked to contact Mr. Brady to see if the piles of sand could be covered to keep them from blowing around.

        Alden Way
        Construction Site Inspection, Merrill Associates

        Town Planner Noreen O’Toole told the Board and residents in attendance that Merrill Associates had completed its review of the Alden Way subdivision.  She said that she had been in contact with Kopelman & Paige, town counsel, and been advised that, in response to a letter received from the developers’ attorney stating all work on the development was complete, a letter should be immediately sent by registered mail to developers Mark Tedeschi and Ken Gray giving them a specific date to complete the problems cited in Merrill’s site inspection reports of December 11, 2006, April 4, 2007 and April 23, 2007.  

        Ms. O’Toole read the letter sent to the developers with copies to their attorney Allan H. Tufankjian of Brockton, Town Clerk Sandra Harris, and Mellon Trust of New England, the bank in which the bond for the project in deposited, giving them until August 3, 2007 to make all the corrections contained in Merrill’s reports emphasizing that the work must be done under the supervision of the Board’s review engineer. Copies of Merrill’s three inspection reports were included with the letters to all parties, she said. She noted that the letter sent by registered mail to the developers was returned.

        She also read Merrill’s April 23, 2007 report, relative to the condition of catch basins and drain manholes, which had been requested by Board members at their April 9, 2007 meeting. Pictures of the existing conditions were included with the report. She said that all the Board can do at this point is wait until the August 3, 2007 deadline.  She told the residents that the bond is in a bankbook, and, according to counsel, that will move things along faster if the town ends up having to take over the bond. She said she would investigate the time frame for the procedure.

        Collamore Estates
        Update

        Town Planner Noreen O’Toole told the residents in attendance that she had spoken with developer William Konish and he has agreed to hire someone to scope the pipe in front of Lot 12 to determine if it is crushed.  The work can only be performed when the weather is dry, she said. Mr. Konish will let the office know when he has a date so that the Board can have its review engineer on site when the work is done.  The residents said that the street light on Whitman Street has not been turned back on and Ms. O’Toole said she would contact the Selectmen’s office.

        
IV.     TOWN PLANNER’S REPORT

        Master Plan Committee

        Town Planner Noreen O’Toole told the Board that the editing of the Master Plan is completed and all that is needed is for Old Colony Planning Council to provide the revised maps.

        Hanson Trails Committee

        Ms. O’Toole said that Trails Committee Chairman Bob Dillon is continuing to move forward on the project and is hoping to have an opportunity to walk the former Plymouth County Hospital property.

        Zoning Bylaw Committee

        Ms. O’Toole said that the Zoning Bylaw Committee will not be able to meet again until some time in June due to town meeting, vacations and a holiday.

        Old Colony Planning Council Joint Transportation Committee

        Ms. O’Toole said that the Old Colony Planning Council Joint Transportation Committee will be meeting on May 17, 2007 at noon in Brockton


V.      ZONING BOARD HEARINGS

        Application of John Bailey for a special permit to allow for the construction of a 52’ long by 10‘ wide deck off the rear of the home at 257 Lakeside Road, Assessors Map 79, Lot 15.  Property is pre-existing, non-conforming and is in a Residence A zone.


        COMMENT:  Board defers to Board of Appeals

        Application of Chilmark Company for site plan approval to allow for construction to begin on Lots 1, 13, 16, 17 & 18 – Phase I of Brookside Estates, in accordance with the terms of the special permit approved on September 16, 2007, on Main Street, Assessors Map 44-Lot 1, Map 44-Lot 10 and Map 36-Lot 8-2.  Property is located in the Flexible Overlay District.


        COMMENT:  Board defers to Board of Appeals but would like to know where                 the lot lines are.
